The new division dedicated to public-private partnerships will be housed within the Senegalese Public Procurement Regulatory Authority (ARMP).

“The texts are being adapted, and the establishment of this department is imminent,” Moustapha Djitte, a magistrate and PPP specialist at ARMP, told Africa Business+. “It will settle disputes that arise in the context of competition and implementation of PPP projects. If there are disputes, the board can be consulted. In the same way, if behaviours that do not obey the regulations are discovered, it will rule on the faults committed and take the appropriate sanctions. So we will have a body that will deal with all issues relating to PPPs.”

In the context of public procurement, sanctions usually take the form of temporary exclusions or financial penalties, types of sanctions that the PPP board could replicate.

For several months, ARMP has been preparing and training its executives on PPP procedures.

“These are complex projects, which require fairly solid expertise. The specific need for additional human resources will be assessed after the establishment of this new department,” said the magistrate and PPP specialist at ARMP. “The legal form of this new division, as well as its organisation and functioning, are not yet defined. And the decision to create a specific directorate has not yet been taken.”

Senegal adopted a new law on PPPs last February to secure investments and encourage projects, notably with a simplification of procedures and a strengthening of monitoring and controls. The ARMP was previously responsible for public contracts and public service delegations. Its remit has now been extended to public-private partnerships.

ARMP is an independent administrative authority affiliated at the organisational level to the General Secretariat of the Presidency. Saër Niang heads it.
